All Elite Wrestling has filed a new motion in the ongoing lawsuit involving Kevin Kelly and the Tate Twins (known as The Boys) against the company, Tony Khan, and Ian Riccaboni.
The lawsuit, initially filed on September 6th, challenges the classification of AEW’s talent as independent contractors, arguing that they should be considered employees. It also seeks to void the arbitration clauses in the contracts of the plaintiffs and certify the case as a class action. Additionally, Kevin Kelly is accusing Ian Riccaboni and AEW of defamation related to comments about Kelly’s support of the film Sound of Freedom, while the Tate Twins accuse Tony Khan of defamation related to claims that they “no-showed” events.
On January 2nd, AEW filed a motion requesting that the court pause any further proceedings, including the discovery process, until the U.S. District Court for the Middle District of Florida decides whether the case should be moved to arbitration. This comes after a judge ruled in November that the case should be transferred from Pennsylvania to Florida, as AEW’s contracts stipulate that all disputes should be handled in Florida, where the company is headquartered.
